AIscend – Terms of Use

These Terms of Use (“Terms”) govern your access to and use of aiscend.co.uk, app.aiscend.co.uk, the AIscend mobile application, and related services (together, the “Service”).

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Introduction

AIscend provides AI-assisted appearance analysis, self-improvement tools, progress tracking, informational insights, and related digital services.

These Terms form a legally binding agreement between you and AIscend regarding your use of the Service.

2. Eligibility

You must be at least 16 years old, or the minimum legal age required in your jurisdiction, to use the Service.

By using AIscend, you represent that you meet these requirements and have the legal capacity to enter into these Terms.

3. Accounts & Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account.

You agree to provide accurate information and to promptly update any information associated with your account.

We reserve the right to suspend or terminate accounts that violate these Terms or create security, legal, or operational risks.

4. AI Features & User Content

AIscend allows users to upload facial photos, scan data, and other content (“Your Content”) in order to generate appearance analysis and related informational outputs.

You retain ownership of Your Content.

By uploading or submitting Your Content, you grant AIscend a worldwide, non-exclusive, royalty-free, revocable licence to host, store, process, analyse, reproduce, adapt, and otherwise use Your Content for:

Operating and maintaining the Service.
Generating facial analysis, scan outputs, and informational insights requested by the user.
Improving, evaluating, testing, developing, and training AI systems, algorithms, and related technologies used within AIscend.
Security, debugging, fraud prevention, and support.

Where required by applicable law or our consent settings, AI training use is subject to your consent.

You may withdraw consent or request deletion of your data in accordance with our Privacy Policy.

5. AI & Analysis Disclaimer

AIscend provides informational, cosmetic, appearance-related, and self-improvement insights only.

AIscend is not medical, psychiatric, psychological, dermatological, nutritional, legal, financial, or professional advice.

AI-generated outputs may be inaccurate, incomplete, subjective, biased, or unsuitable for your circumstances.

You should not make medical, mental health, financial, employment, relationship, or other significant decisions based solely on AIscend outputs.

If you experience body-image concerns, eating disorders, dysmorphia, mental health difficulties, or emotional distress, seek advice from an appropriately qualified professional.

6. AI Chat Features

Certain AIscend chat features may use OpenAI’s API or related AI providers to generate responses.

By using chat features, you understand that chat messages and associated context may be transmitted to these providers solely to generate responses and operate the feature.

Facial scan analysis is not performed by OpenAI.

7. Subscriptions & Billing

AIscend may offer paid auto-renewable subscriptions through Apple In-App Purchases.

Subscription titles, prices, durations, and features are shown inside the app before purchase.
Payment will be charged to your Apple ID account at purchase confirmation.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
Your account will be charged for renewal within 24 hours prior to the end of the current billing period.
You can manage or cancel subscriptions through your Apple ID account settings after purchase.
Any unused portion of a free trial may be forfeited after purchasing a subscription where applicable.

8. Acceptable Use

Do not upload unlawful, abusive, harassing, hateful, exploitative, infringing, or sexually explicit content.
Do not attempt to reverse engineer, disrupt, scrape, overload, or gain unauthorised access to the Service.
Do not misuse the Service in a manner that violates law or the rights of others.
Do not upload content you do not have permission to use.

9. Account Deletion

Users may initiate account deletion inside the AIscend app.

When an account deletion request is completed, AIscend will delete or anonymise associated personal data where reasonably possible, subject to legal obligations, fraud prevention, security, technical limitations, and backup retention systems.

10. Service Availability & Changes

The Service is provided on an “as is” and “as available” basis.

We may modify, suspend, discontinue, or remove features at any time without liability.

We do not guarantee uninterrupted availability, accuracy, or error-free operation.

11. Intellectual Property

Except for Your Content, all software, branding, interfaces, graphics, text, models, algorithms, datasets, and materials forming part of the Service are owned by AIscend or its licensors.

You may not copy, distribute, sell, modify, or create derivative works from the Service except where permitted by law.

12. Limitation of Liability

To the fullest extent permitted by law, AIscend shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, loss of data, reputational harm, emotional distress, or business interruption.

AIscend’s total aggregate liability relating to the Service shall not exceed the greater of:

£100 GBP; or
The amount you paid to AIscend during the previous 12 months.

Nothing in these Terms limits liability where limitation is prohibited by law, including fraud or death/personal injury caused by negligence.

13. Suspension & Termination

We may suspend or terminate access to the Service if we believe you violated these Terms, created legal or security risks, engaged in abuse, or used the Service unlawfully.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales.

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Changes to These Terms

We may update these Terms from time to time. Updated versions will be posted on this page with a revised “Last updated” date.

Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
